The 50-year-old singer – who announced earlier this month she and Guy are splitting after nearly eight years of marriage – is believed to have made an emotional phone call to the director on Tuesday night to come to an amicable agreement about the separation.

A source told the MailOnline website: “It was a very emotional call and a sign of the desperation Madonna feels for them to settle before things start getting more serious legally.

“Madonna tried to remind Guy of all the good times, said how they must settle before it got any more messy and public. She said she had always worked so hard to provide for the family. She said she had been saddened by some of the criticisms of her which appeared to have come from his camp.”

Madonna, who raises three children with Guy, was reportedly encouraged to contact her estranged spouse by her Kabbalah spiritual leader Rabbi Berg.

Berg wants the couple to remain on speaking terms so the reputation of Kabbalah, a mystical offshoot of Judaism, is not damaged.

A source close to Madonna said after the tearful conversation, the singer cried openly in front of her staff for the first time, after the strain of their bitter split took its toll.

“Madonna and Guy Ritchie have agreed to divorce after seven-and-a-half years of marriage. They have both requested that the media maintain respect for their family at this difficult time,” reads the short statement e-mailed to the Associated Press by Liz Rosenberg.

The statement, which was co-signed by Ritchie’s representative, also said that the couple had not agreed to a settlement.

“The judgment of the court would be to try and assess what they came in with and divide what they built up fairly equally,” said David Allison, a lawyer with Family Law in Partnership, a London firm, told the AP.

The ’4 Minutes’ singer was said to be impressed by Fiona Shackleton’s handling of the former Beatle’s bitter battle with ex-wife Heather Mills and wants her to represent her case against Guy Ritchie.

A friend of the singer insists Fiona is the natural choice for Madonna, telling Britain’s Daily Mirror newspaper: “Madonna always seeks out the best in whatever field she is interested in at any given time. Fiona Shackleton is the best.”

Madonna – who reportedly has no pre-nuptial agreement with Guy – had been hoping to resolve their difference but has reportedly realized their relationship is irreparable, she needed a proper legal consultation.

One friend of the lawyer – who also represented Prince Charles in his divorce from Princess Diana – said: “Madonna was impressed by Fiona’s work for Paul and the way she handles herself in the public eye. She is a consummate professional.”

Earlier this month, Madonna was forced to deny rumors she had been having talks with Nicholas Mostyn QC – the lawyer who represented Heather in her divorce from Paul.

Madonna’s spokesperson denied those claims, but of the latest rumors would only say: “We are unable to comment on this.”

Madonna, 49, and Guy, 39, have a seven-year-old son Rocco and an adopted son David, two. Madonna also has a daughter, 11-year-old Lourdes, from a previous relationship.

The pair, who have not been photographed together for weeks, were said to be leading separate lives.

But Liz Rosenberg, Madonna’s US spokeswoman, said: “I am delighted to confirm that Mr and Mrs Guy Ritchie remain happily married.”

Madge’s lawyers are afraid the images will affect her “stick up her ass” persona. No, they are afraid it will affect her adoption of David Banda. The head of the Malawi child welfare service is about to spend a week with Madonna and David in London and she doesn’t want those pictures in the papers.

The pictures and letters are being shopped around for a price tag of around $200,000.
